SHC restrains Customs from arresting accused Custom Officer

KARACHI: The Custom department was restrained from arresting a Principal Appraiser, accused of collusion with importer, fabricating fake documents etc.

A bench of Sindh High Court (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Mahmood Ahmed Khan earlier heard Ghulam Hyder Shaikh advocate, counsel for petitioner who maintained that his client presently posted at Port Muhammad Bin Qasim has a 30 years of unblemished service and allegations levelled against him were due to enmity. The counsel sought protection from action by the Investigating Officer (IO) and said petitioner is being harassed and humiliated.

The counsel from Franklin Law Associates submitted that the GD’s in this case were filed on WeBOC system (Yellow Channel) which were initially examined by the Appraising Officer after whom the same were approved by the Petitioner being Principal Appraiser and responsible to determine value, duty and taxes. The petitioner cannot examine the genuineness of the documents including LC EIF Form or else which according to Prosecution were found fake.

The bench after hearing the arguments ordered issuance of pre-admission notices to the respondents for Dec 12 while directing that IO of the FIR against petitioner/accused shall be in attendance with all relevant details against the petitioner. The petitioner/accused was also directed to cooperate with the prosecution and provide all relevant documents as permissible under the law. The bench also restrained the respondents from arresting the petitioner till next date of hearing.
