KARACHI: An appellate bench of High Court of Sindh (SHC) on Wednesday adjourned hearing of a Income Tax Reference Application (ITRA) till Nov 27 asking the petitioner side to file documents so that it could be examined that how a case can be re-opened on same set of allegations.
The bench earlier heard counsel appearing for the petitioner Jamshoro Power Company Limited, an electricity generation company (Genco-I).
The counsel submitted that the Income Tax Circle concerned conducted an audit and also checked all accounts register maintained by the petitioner duly and later served them with a show cause notice under section 122 (5) of the Income Tax Ordinance. They made wrong calculations and raised a demand.
The said order was annulled by the appellate authority. Thereafter they suddenly reopened the case.
The bench after a detailed hearing asked that how can a case be reopened by the tax authorities on same set of allegations.
The bench then directed the petitioner side to place all relevant documents on record including first set of proceedings. The bench later put of further hearing till Nov 27.
