KARACHI: An appellate bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Mahmood A Khan on Friday restrained Sindh Chief Inspector, Revenue from recovery of stamp duty from Unilever Pakistan.
The bench heard Haider Ali Khan advocate who challenged an order passed by Chief Inspector, Stamps. The counsel submitted that the petitioner are entitle to exemption. It was a federal subject while province has no power to impose and recover such a duty, the counsel contended citing stay granted by the SHC bench in an identical matter involving controversy of jurisdiction available to federation or a province (province of Sindh). We are exempted under Electronic Transaction Ordinance, the counsel argued praying to the court to stop coercive recovery of stamp duty.
The bench later stayed the recovery proceeding/demand till next date of hearing.
