KARACHI: Issuing pre-admission notices to the Deputy Collector, Preventive, Oil Installation Area, Keamari and Director, Post Clearance Audit (Customs) Karachi for Nov 18, a customs appellate bench of High Court of Sindh restrained the respondents from enforcing recovery of demand raised by them.
The bench earlier heard Afhseen Aman advocate appearing for petitioner General Enterprises who submitted that an appeal has been filed against Order in Original no 61/2018-19 along with an application for stay of recovery notice. The appeal has been numbered as K-1111 of 2018 and is pending. She submitted that at present the appellate tribunal is not functional whereas the respondents are creating harassment to the petitioner who apprehends coercive measures. She prayed to the court to restrain the respondents from enforcing recovery till final decision in appeal by the special appellate tribunal.
The bench allowing the request while issuing pre-admission notices for Nov 18 also sought comments from the respondents.
