KARACHI: A division bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Mahmood A Khan asked provincial government to place all details pertaining to a toll plaza established at Lucky Pahari, Baldia Town, Karachi.
The bench was hearing a petition challenging the establishment of the toll plaza within the city limits. The counsel for petitioner submitted that earlier the toll plaza existed 15 kilometer ahead in Balochistan region and without any justification it was shifted to present place which is in the limits of Baldia Town Karachi.
The counsel submitted that due to this illegal shifting of the toll plaza residents of the area are facing harassment at the hand of staff posted for collecting toll fee.
The Assistant Advocate General Sindh Mr Saif said that a parallel road exists and the local residents could use that road if they do not want to pay toll fee. No use no fee is the principle, he said. He also submitted that it was notified highway and thus Sindh government can establish a toll plaza where it deems appropriate.
The bench after hearing the sides ordered the counsel for Sindh government to lay all documents including notification of the highway and etc The bench later put off further hearing till Nov 18.
