KARACHI: Justice Faheem Ahmed Siddiqui of High Court of Sindh (SHC) on Thursday admitted a clearing agent to bail after arrest against a solvent surety of rupees one million.
The accused/applicant Muhammad Amir son of Muhammad Siddique was booked by Sales Tax department (IRS) for abusing the concession under SRO 1125/2011 while showing Mind Messers Challenge as importer and manufacturer.
Zia-ul-Hasan advocate appearing for the accused submitted that the applicant/accused is a clearing agents who depends on the documents provided to him by importer and if there is a problem with the certificate issued by the IRS or any abuse of such certificate by importer do not render the clearing agent responsible for such an act of omission or commission.
The bench after hearing the arguments granted bail to the applicant/accused against a solvent surety of rupees one million. The imported consignment was of finished fabric while the importer was entitled to import of raw material (yarn). Four co-accused are already in custody.
