KARACHI: A customs appellate bench of High  Court of Sindh (SHC)  issuing pre-admission notice to the custom officials for July 10,  ordered release of consignments imported by M. R Enterprises consisting of plastic scrap.

The bench earlier heard Dr Shahnawaz advocate representing the importer company who contended that petitioner firm is registered with sales tax department as manufacturer. The respondents on 31-5-2019 has passed an Order in Original  whereby it was held that petitioners capacity to make granules does not commensurate with the volume of import made by the petitioner. The counsel further stated that an appeal has been filed before Collector (Appeals) against this ONO. He prayed to the court to order the respondents to  allow release of fresh consignments of the petitioner as neither there is an issue of duty and taxes or classification, nor there is any violation of the Import Policy Order 2016 as alleged by the respondent custom officials.

The bench after a detailed hearing while ordering issuance of the pre admission notices to the respondents for July 10 and asked them to file comments if any. The respondents were also directed to allow release of the consignments of the petitioner . The custom was also asked to re-examine the issue of capacity of the petitioner to manufacture plastic granules, by associating the petitioner  and submit  compliance on the next date of hearing i.e July 10.
