KARACHI: The Advocate General Sindh was put on notice by an appellate bench of High Court of Sindh in a petition challenging a SRO levying Sales Tax on Cotton Seed with retrospective effect.
The petitioner challenging the demand for payment of Sales Tax maintained that Entry 81 of Sales Tax exempts Cotton Seeds from any levy. He maintained that a previous SRO has been struck down after which new SRO has been issued with retrospective effect and hence illegal and void. To a question by the court, the counsel for petitioner submitted that an appeal against the judgment of SHC is pending before Supreme Court of Pakistan as leave to appeal have been granted but no restraining order was passed by the apex court.
The bench in view of the challenge to the law ordered issuance of notice to the Advocate General Sindh.
