KARACHI: A customs appellate bench of High Court of Sindh (SHC) on Monday ordered Pakistan Customs to assess the consignment of toiletries on the basis of data.
The bench was hearing a constitution petition filed by U & M Marketing Limited challenging the determination of custom duty and taxes on enhanced value in the presence of Valuation Ruling.
SHC has already ruled that the Director Valuation has no power to determine custom duty and other taxes. The consignments in cases of identical nature have been released and petitioner is also entitled to relief under section 25-D of the Customs Act 1969, the counsel for petitioner maintained.
The bench later disposing of the petition ordered the department to assess the consignment on the basis of data available and release the same on payment of duty and taxes admissible.
