KARACHI: A customs appellate bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Zulfiqar Ahmed Khan on Monday fixed a constitution petition filed by Nizam Energy about their consignment of solar panels and batteries for hearing on Nov 28.
The bench earlier took on record legal issued framed by the sides. The petitioner side represented by Franklin Law Associates submitted that as per Entry number 23 & 24 in 5th Schedule of Customs Act and Sixth schedule of Sales Tax Act, the importer of solar panels and batteries is entitled to exemption.
The petitioner seeking release maintains that denying release of the consignment is illegal and may hit country’s effort to switch over to solar power generation.
The bench after hearing counsel for the department fixed Nov 28 for a final hearing and decision.
