KARACHI: A customs appellate bench of High Court of Sind (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Zulfiqar Ahmed Khan on Monday disposed of a petition filed by Horizon International challenging holding of consignment of Indian fabric with the direction to Colletorate of customs concerned to remain careful in future.
The bench was hearing a petition filed by Horizon International through Franklin Law Associates. The counsel for the law firm argued that petition was filed as the consignment was detained for no reason. The same was released as notice was issued by the SHC.
The counsel submitted that due to illegal detention of consignment, petitioner was slapped with demurrage and therefore delay detention certificate is being sought by the petitioner.
The bench after hearing the sides asked the petitioner to file an application before the Collector, Pakistan Customs, Port Qasim Collectorate for delay detention certificate while department was asked to consider the same. In case of failure, the bench noted that petitioner is free to take further legal recourse. The bench also asked the respondents to be careful in future while detaining consignments for ‘no reason’.
