KARACHI: An appellate bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Nazar Akbar on Tuesday heard dozens of appeals filed by Pakistan Customs against different importers including importers of generating set and cotton.
The bench in the initial stage was under impression that HCA’s (High Court Appeals) fixed today involve identical issue and assail a common judgment but later found it that there were two different set of appeals and judgments/proceedings are also different.
The appellant department filing the appeals through Masooda Siraj and Kashif Nazeer Advocates challenge maintainability of the suits and that whether the plaintiffs are entitled to exemption from duties and taxes on import of generating sets in terms of Schedule V of the Customs Act 1969 read with Section VI of Sales Tax Act, 1990.
The bench separating at least two cases pertaining to import of cotton, put off further hearing till April 27.
