KARACHI: An appellate bench of High Court of Sindh (SHC) comprising Justice Munib Akhtar and Justice Arshad Hussain Khan on Tuesday dismissed a miscellaneous application filed by Zeal Pak Cement Factory Limited praying for provisional release of subsequent consignment.

The bench earlier heard Khawaja Shams-ul-Islam advocate, counsel for petitioner/applicant in petition 2/2017. The counsel referred to an order dated 31-1-2017 allowing provisional release of the consignment imported for a project. A part of the consignment was detained by the DIT officials he told the bench. To another query that how the application being heard is connected to the petition above, counsel for petitioner/applicant submitted that under the garb of previous order, respondent Custom officials are  assessing the new imports at a rate of US $ 34 as against US $ 20 (claimed by the petitioner side).

The bench observed that petition 2/2017 was very specific in nature and subsequent imports do not relate to it. The bench with the above observation dismissed the application and said petitioner/applicant  is free to take appropriate proceedings for new, subsequent imports.
