KARACHI: A division bench of High Court of Sindh comprising Justice Munib akhtar and JusticeYousuf Ali Sayeed on Friday directed the Pakistan Customs, Collector, Appraisement East to see that application filed by a petitioner/importer is decided.
Earlier the counsel for petitioner Elahi Traders, Peshawar submitted that the petitioner imports spray and other items from China on regular basis. He said that petitioner imported a consignment of snow spray and all documents in support have been submitted to the authorities. They were requested to assess the consignment as per order of the Supreme Court of Pakistan which ruled that all cases under section 25-D of the Customs Act 1969 be decided at the earliest.
Masooda Siraj advocate representing the Director General Valuation, a respondent in the petition submitted that application filed by the petitioner is missing. She assured the court that once application is found or moved by the petitioner, it would be decided soonest.
The counsel for petitioner submitted that the application is pending decision before Director Valuation since March 09. The demurrage is increasing day by day.
The bench however asked the counsel for petitioner to approach the authority concerned with copies of the application while counsel for respondents was asked to sort out the issue.
The bench then put off further proceedings till April 06.
