KARACHI: Please read the first line of your comments, what you intend to say, asked a division bench of High Court of Sindh from a lawyer appearing for the Pakistan Customs Preventive on Monday in an old case of detaining imported goods including LCD’s etc.
The bench was hearing a petition filed by one Haji Saeed who sought implementation of an order passed by the tribunal in 2014. The bench noticed the fault as it started reading the para wise comments and many times reminded the lawyer appearing for the department to read the opening sentence.
The bench then asked Dil Khurram Shaheen advocate that why the petition was filed now in 2017 while the order of the tribunal was passed way back in 2014. Where was the petitioner in the intervening period, the bench asked.
She told the court that her client kept approaching the respondents who avoided to attend the request on ground that they have filed Special Customs Reference Application (SCRA) against the order of the tribunal.
As the lawyer for the department as well as officer from the customs was unable to tell the court about SCRA, the bench was told by the counsel for petitioner that respondents have filed two SCRA’s 581 and 582 of 2014.
The bench after this statement by the counsel for petitioner deferred further hearing till Feb 28 ordering the office to put up the petition along with the SCRA’s for hearing and decision.
