KARACHI: Taking a serious exception to non implementation of judicial orders, a division bench of High Court of Sindh (SHC) comprising Justice Muneeb Akhtar and Justice Muhammad Humayun Khan ordered Customs Appraiser Tariq Aziz for forthwith release of consignment of petitioner Jallo Paints Private (Limited).

The bench earlier heard an application for urgent hearing moved by Ghulam ullah Sheikh advocate of Franklin Law Associates who stated that despite orders of the court, the valuation department is holding the consignments without any reason. He further submitted that all duties and taxes have been paid.

The bench during perusal of the file found that two Orders in Original (ONO’s) have been passed by the Custom authorities which have been complied by the petitioner.

The bench drew the attention of Masooda Siraj Advocate to the fact and said that when the ONOs have been complied with by the petitioner the customs cannot hold the consignments.

The counsel for Customs department said that consignment was not released because of excess quantity found.

The consignment cannot be held in this manner and in violation and disregard, disrespect to the orders of the court, the bench said while warning the Principal Appraiser as well as counsel to ensure forthwith release of the consignments. The bench also ordered that if consignments are not released then Collector Custom concerned (Port Muhammad Bin Qasim) to appear in person on next date of hearing which was fixed to be Dec 09.
