KARACHI: An appellate bench of High Court of Sindh (SHC) comprising Justice Muneeb Akhtar and Justice Muhammad Humayun Khan on Thursday asked the Pakistan Customs to submit para wise detailed comments in a constitutional petition filed by Jallo Paints.
Earlier the court heard initial arguments advanced by Ghulam ullah Sheikh advocate of Franklin Law Associates, counsel for the importer who submitted that consignment was held without any valid ground and thus needed to be ordered to be released forthwith provisionally.
Masooda Siraj Advocate assisted by Sardar Zafar Hussain advocate opposed the request for provisional release. The act of holding the consignment was legal and on valid ground as it was an established case of “mis-declaration”, the Customs side maintained. The petitioner filed the GD under self assessment facility but his consignment was selected for examination under “Red Category”, the counsel for customs maintained. The respondent department relied on an Order in Original.
The bench after hearing both the sides ordered Pakistan Customs to submit the detailed para wise comments by Dec 05, next date of hearing.
