KARACHI: A division bench of High Court of Sindh (SHC) comprising Chief Justice Sajjad Ali Shah and Justice Zulfiqar Ahmed Khan on Thursday disposed of a constitution petition filed by the Mehtab Steel Corporation in terms of Order in Original passed by Collector Customs (Adjudication).

The Secretary FBR, Collector Customs, MCC, Port Muhammad Bin Qasim (One Customs) and Deputy Collector, PMBQ are cited as respondents in the case. The bench was moved by the petitioner corporation seeking a directive to the Nazir of the court to release the securities lying within him so that Customs’ duties are paid.

According to details petitioner imported “Prime Quality Electrolytic Tin Plate” over 200 metric ton and filed a GD at a rate of US $ 700 PMT processed by  group at a rate of US $ 1185. A contravention report was also generated for under invoicing against the petitioner.

The case was then referred to the Collector Customs (Adjudication) on in ONO dated 7-8-2013 directed the custom officials to revisit the assessment.

The matter was then referred for re-assessment and custom duty and taxes were then assessed to be US $ 1040 per MT.

The bench today after hearing the counsel for petitioner as well as respondents including Masooda Siraj advocate for “One Customs” disposed of the petition in terms of order in original (passed by Collector Customs; Adjudication for revisiting/ revising the first assessment.
