KARACHI: An appellate bench of High Court of Sindh (SHC) comprising Justice Aqeel Ahmed Abbasi and Justice Abdul Malik Gaddi on Friday adjourned hearing of a Special Customs Reference Application (SCRA) against order of the Customs Appellate Tribunal in respect of High Speed Diesel (HSD).
Messers Gas and Oil Pakistan limited filed the SCRA maintaining that they are a marketing, storage, transportation and supply operation having more than 150 outlets in Punjab alone with and increasing network. The applicant maintained that two of its oil tanker filled with 109098 litres of HSD were intercepted at Mochko by police which later informed the Custom authorities of the HSD being smuggled. The applicant maintains that they submitted the Delivery Order issued by Byco Pakistan having filler station at Hub near Karachi and that the confiscated consignment was locally manufactured HSD. They questioned the decision of the tribunal that on the basis of “flash point” it is not a Byco product but a smuggled one.
Today when the SCRA came up for hearing, counsel for Customs department said that copies of the application were supplied to them. The bench directing the applicant to supply copy of the SCRA to the respondent side put off hearing to a date to be fixed later by the office of the court.
