KARACHI: An application filed by Appraising Officer (Research and Development), Customs Appraisement, Model Customs Collectorate, MCC West under section 151 C.P.C against petitioner AMI Pakistan Limited was admitted for hearing by a divisional bench of Sindh High Court.
The bench comprising Chief Justice Sajjad Ali Shah and Justice Zulfiqar Ahmed earlier heard the Principal Appraiser Law Ilyas Ahsan on Wednesday.
The applicant seeking a review of an interim order passed by the same bench maintained that their counsel without consulting the respondents/applicant assured the court that no action will be taken against the petitioners 2, 3, 4 and 5, as they are not the beneficiaries of alleged crimes.
The application maintains that the petitioners including wife and sons of Captain (RTd) Haleem Siddiqui equally benefitted with the activities of the petitioner no one (AMI). It is proved that petitioners who hold majority shares are the ultimate beneficiaries of the scam/crime.
It was also maintained that while petition CP-D 882/2016 was filed on ground that employees of the petitioners mis-used their authority and indulged in the crime whereas investigations so far carried out by applicants confirm that this phenomenon of fraudulent manifestation of consignments was going on for years.
The directors of AMI are accused of conniving with the clearing agent Sharjeel Jamal in clearing consignments of Indian origin cloth declaring it to be of Chinese origin. The import from India is banned and this illegal activity drew the local textile industry to the brink of a disaster.
The applicant prayed to the court to initiate proceedings against the petitioners/respondent directors of the AMI being ultimate beneficiaries of the scam/crime.
The bench admitting the application and after waiver of notice by the petitioners fixed April 7 as date for hearing of the instant application.
