KARACHI: A constitution petition pertaining to Valuation Ruling in respect of servo motors of sewing machines was disposed of here Thursday by a divisional bench of High Court of Sindh directing the Pakistan Customs to return the custom duty and taxes if Customs Appellate Tribunal passess orders in favor of the petitioner/appellant.
The bench heard Ghulam Nabi Shar advocate representing Ramzan Sewing Machine and Silk Yarn , Multan who sought release of consignment on payment of even differential amount. He submitted that the valuation Ruling (VR) 750/2015 dated 22-6-2015 has prejudiced the interest of petitioner and other importers of the identical goods as VR 750 increased the value to a very high proportion. The VR is violative of Section 25 of the Customs Act 1969, he contended adding that petitioner would be at great disadvantage if VR is not revised downward.
Masooda Siraj advocate counsel for Directorate of Valuation objected to the maintainability of the petition and submitted that petitioner has filed an appeal against the order of the DG Valuation hences has availed the remedy available to him.
Ghulam Nabi Shar advocate citing judgments of the SHC in identical matters pressed for release of goods. The bench comprising Chief Justice Sajjad Ali Shah and Justice Awar Hussain disposed of the case directing the Custom Valuation/Collector Customs West to return the duty and tax if tribunal allows appeal by the petitioner/appellant in 30 days. The VR 750/2015 fixed the value of China made servo motors 100 180 wats at the rate of US $ 2.25, 300 Watt at US $ 3, 400 Watt US $ 28/pc and 550 Watt at US $ 30/pc which is impugned by the petitioner.
