KARACHI: The Director General, Customs Valuation, Samaira Nazir Khan rejected two identical revision petitions against Valuation Ruling 759/2015 dated 9-9-2015.
The revision petitions were filed by U Trade Logistics private Limited and Indus Automobiles Private Limited under section 25-D of the Customs Act 1969 against custom value of brake fluid determined, vide Valuation Ruling no 759/2015 issued by Director, Customs Valuation Karachi.
The petitioners maintained that they are the regular importers of the brake fluids (retail packs) from various sources. The maintained that the VR 759.2015 aggrieves them as the prices of the petrol and petroleum products including brake fluid have come down drastically and the difference between the bulk and retail is of almost 100 per cent. It was contended by the petitioners that basis of the revision is only confined to the market enquiry without adopting the sequential method as per section 25 of Customs Act 1969 therefore the customs value determined is exorbitant and unreasonable. The petitioners also contended that contents of the valuation ruling do not show the method of calculation and same has not been incorporated in the impugned VR and also the 90 days data was not considered before issuance of the impugned VR.
The petitioners also submitted that arbitrary and whimsical issuance of the impugned VR would block the imports through legal channel and encourage smuggling and abusers of the Afghan Transit Trade (ATT) facility.
The respondent Director Customs Valuation in his reply submitted that all valuation methods including sequential method were adhered while Transaction value method was found in applicable, as requisite information was insufficient, unreliable. The respondent also maintained that applicant/petitioner failed to substantiate its claim of drastic changes in the values of the Brake Fluid Oil through supporting documents.
The Director General, Customs Valuation while rejecting the revision petitions held that applicant/petitioner failed to prove their case through documentary evidence and that department has proceeded as per law.
