KARACHI: Federal Tax Ombudsman (FTO) has asked the chairman Federal Board of Revenue (FBR) to take immediate notice of arbitrary and unlawful conduct of the field formations.
The FTO observed in appeal filed by M/s Sadiq Feeds Pvt Ltd – which in its complaint contesting non-issuance of refund for tax year 2013 – that delay in issuance of refund for tax year 2013 despite commitment and passing arbitrary order without lawful authority in a vindictive and arbitrary manner for tax years 2011 and 2012 is cognizable under FTO Ordinance 2000.
In the order the FBR has been asked to direct the chief commissioner concerned to issue refund/compensation due, as per law, for tax year 2013 within two weeks.
The FBR has also be directed the commissioner concerned to invoke the provisions of Section 122 A for tax years 2011 and 2012 for ascertaining the true facts in a transparent manner by affording fair opportunity of hearing to the complainant.
The FTO observed in the case that it was a typical example of highhandedness and arbitrary conduct of the field officers.
