KARACHI: A custom appellate of High Court of Sindh comprising Justice Muhammad Junaid Ghaffar and Justice Muhammad Abdur Rahman on Tuesday allowed 20 Special Custom Reference Applications (SCRA’s) filed by Collector of Customs, South Asia Pacific Terminal (SAPT), through Sardar Zafar Hussain Advocate.

The respondents include M/s Idrees Steel Co, Karachi, Sama Trade Karachi and Diamond Steel, Karachi represented by Aqeel Ahmed Khan Advocate.

The bench set aside the order of the tribunal passed on the basis of an earlier judgment in Custom Appeal No K-842 of 2023 under which Valuation Ruling No 1720/2022, dated 22.12.2022 was suspended.

The bench in its  order noted that forums below including Custom Appellate Tribunal failed to appreciate that the said order of the Tribunal is now sub judice before this bench wherein such judgment has been  suspended. The propriety demanded that they ought  to have shown restraint in passing any final order till such time the pending Reference Applications are decided.  

The bench then suspending the order of the tribunal remanded the cases back to the tribunal with the direction to adjourn these appeals sine die till matter / fate of Valuation Ruling 1720/ 2022 is decided by this court.
