KARACHI: A suit filed by Novartis Pharma Pakistan Limited assailing a Show Cause Notice against Collector of Customs Appraisment, West and others was dismissed by a bench of High Court of Sindh.
The plaintiff company was represented by Kazim Hasan Advocate who was called absent and Mr Sauban Tasleem Advocate held brief for him. Ms Afsheen Aman advocate alongwith Ms Hani Fatima advocate appeared for the custom officers.
The bench held that it is a settled law that show cause notice ought not to be ordinarily entertained outside the statutory hierarchy and can be seen from the judgment in the case of Commissioner Inland revenue v/s Jehangir Khan Tareen.
The bench also noted that plaintiff side is absent without any cogent reason and dismissed the same for non-prosecution.
