KARACHI: Twenty five Special Custom Reference Application No 431 of 2011 to 456 of 2011 were finally decided by a custom appellate bench of High Court of Sindh allowing appeals filed by Collector of Customs challenging an order passed by Custom Appellate Tribunal on 3011.2010.
The issue pertains to the existence and application of a Valuation Ruling dated 14.2.2008 and crux of the matter was that whether Valuation Ruling is valid beyond 90 days or unless altered and that whether Valuation Ruling can be applied on consignments cleared prior to issuance of Valuation Ruling, on the basis of transactional value.
The bench heard arguments from Syed Zafar Hussain Advocate appearing for the applicant department and after perusing the case record allowed all the appeals setting aside the order of there tribunal.
