KARACHI: A petition filed by a foreigner Honwei Liu through Ghulam Nabi Shar Advocate was dismissed by a custom appellate bench of High Court of Sindh.
The bench comprising Justice Muhammad Shafiq Siddiqui and Justice Agha Faisal at the outset noted that petitioner has not availed the departmental remedy available to him.
This view was taken after Sardar Zafar Hussain Advocate drew the attention of the bench to the fact that the for the relief, the petition was filed, he has to file an application under Section 83-B of the Customs Act 1969 before the Collector of Customs concerned.
The counsel for the department further said that if the petitioner files such application it will be considered strictly according to law.
The bench agreed to the contentions by Sardar Zafar Hussain advocate, counsel for custom officials and held that petition is being filed pre-maturely. The bench then disposed of the petition leaving the petitioner free to “avail appropriate remedy identified” by the departmental counsel and said if such an application is filed it shall be considered as per law.
