KARACHI: An appellate bench of High Court of Sindh hearing an appeal against ad-interim order ex-part order passed by a single judge of SHC suspended the interim order while disposing of the appeal filed by Askari Insurance Company.
Dr Shahab Imam advocate representing the appellant maintained that single judge passed the interim order without hearing the appellant and suspended the operation of a letter under which license was granted to the appellant company. The order was passed on an injunction application moved by Tracking World (Pvt) Ltd. Haider Waheed advocate is representing the Tracking World Pvt Ltd. He challenged the maintainability of the appeal and said that appellant could have moved for recall of impugned ad-interim order before the judge passing the order.
The appellate bench after going through the case file reached to the conclusion that single judge passed the order without examining all the relevant facts and affording opportunity of hearing to the appellant.
