KARACHI: Additional Collector, Adjudication I, Sajjad Hyder Jhinjhin passed an Order in Original against importer Fatima Ferltizer Pvt Ltd Multan and its Clearing Agent Ms Agility Logistics Pvt Ltd, Karachi on charge of availing an in-admissible exemption.
According to details, the importer imported 132 Filter candles and filed a Goods Declaration KAPW-HC169367 under HS Code 8241.3990. The importer also availed exemption under Serial No 15 of Table I of 5th Schedule of Customs Act 1969.
The DIT became active on a tip off and seized the consignment. Upon examination, the goods were found as per description and quantity. The DIT issued a Show Cause Notice to the importer on alleged charge of short payment of duty of rupees 624922.
The importer went into adjudication where upon the Adjudicating Officer held that charge levelled in the Show Cause Notice regarding “misdeclaration of SRO stands proved” against the importer and clearing agent. It ordered confiscation of the offending goods but gave a chance to the importer to pay a redumption fine and penalty of rupees 50000.
