KARACHI: An Order in Original (ONO) passed by Collector Adjudication was suspended by a custom appellate bench of High Court Of Sindh here on Wednesday.

The bench earlier heard Khalid Rajpar advocate counsel for DG I&I who challenged the ONO and submitted that department gas filed an appeal against said ONO and also filed an application for stay but could not obtain any  restraining order as the customs appellate tribunal is not functional.
The counsel for respondent/owned has filed an application before petitioner DG I&I for implementation of impugned ONO, Khalid Rajpar advocate pleaded adding that there is no alternate remedy except filing the instant petition.

He prayed to the court to suspend the operation of impugned ONO till decision in appeal.

The bench after hearing the counsel for petition suspended the ONO till April 14 while ordering issuance of notices to the respondents.

According to petitioner/appellant  department, vehicle in custody has a welded replaced chassis and thus is an smuggled vehicle.
