KARACHI: Justice Junaid Ghaffar of High Court of Sindh gave a last chance to plaintiff Shaheen Air International (SAI) to deposit Rupees 2.2 billion, 50 per cent of disputed amount of custom duties etc.
The bench was hearing a suit filed by the SAI challenging tax on aircrafts it took on wet lease. The plaintiff side maintains that as the aircrafts were brought in temporarily, no tax etc can be levied.
The counsel for defendant Pakistan Custom and others maintain that if aircrafts are held back for more than six months, taxes etc are applicable. The defendant’s counsel also submitted that plaintiff is unable to pay 50 per cent of the disputed amount as per settled dictum by the Supreme Court of Pakistan and thus suit is liable to be dismissed.
The bench however giving a last chance to the plaintiff adjourned further proceedings till Dec 03.
