KARACHI: A division bench of High Court of Sindh (SHC) comprising Justice Irfan Saadat Khan and Justice Muhammad Humayon Khan dismissed for non-prosecution, a constitutional petition filed by Jamshoro Power Company Limited against Commissioner and Deputy Commissioner of Inland Revenue, Zone II, RTO Hyderabad.

The petitioner company moved the court against a demand notice for recovery of alleged unpaid amount of Income Tax. The petitioner moved the Income Tax Appellate Tribunal which also decided the ITA. In the intervening period, the instant petition was also filed. Later the petitioner also filed an Income Tax Reference Appeal (ITRA 145 of 2015).

When the petition came up for hearing, the counsel for respondent IR officials submitted that the counsel for petitioner is avoiding appearance as the petition has served its purpose particularly when ITRA has been filed and pending before this court (SHC).

The bench perusing the order passed on previous date of hearing 21-10-2016 , absence of the counsel for petitioner and submissions by the counsel for respondents dismissed the petition for “non -prosecution”.
