KARACHI: The Income Tax Appellate Tribunal, Karachi has stopped work after the judgment by a single member bench of Islamabad High Court announced on Feb 24, 2016 declaring the appointment of member judicial of tribunal as illegal if not done after meaningful consultation with the Chief Justice.
The bench comprising Justice Athar Minallah also directed federal government to immediately appoint new members as per judgment. As the judgment announced in open court was not sent or circulated to the departments concerned, Custom Appellate tribunals, Sales Tax tribunals are functioning.
According to a member judicial at Karachi, the judgment by the IHC single judge has been challenged before the Supreme Court of Pakistan and hearing of appeal is fixed for Wednesday (March 02).
If no stay was granted, the judgment will prevail requiring of all the tribunal headed by member judicial to stop work forthwith. So far utter confusion prevails in the legal circles.
