KARACHI: A divisional bench of High Court of Sindh (SHC) comprising Chief Justice Sajjad Ali Shah and Justice Zulfiqar Ahmed Khan on Tuesday disposed of a constitution petition filed by Pervez Sons, importers of NB Rubber directing the Special Customs Appellate Tribunal to decide the appeal by petitioner in a month time.
The bench earlier heard counsel for petitioner who submitted that he filed the Goods declaration per Valuation Ruling for NBR but Director Customs Valuation refused to accept the same. The order in original was then impugned before the Director general Valuation who also rejected the claim of the importer after which the petitioner filed an appeal before the tribunal which is pending a decision.
The petitioner maintained that in the mean while, the custom officials initiated proceedings for recovery of Customs Duty and attempted to en-cash the cheques deposited with them. The petitioner relying on the judgment in Jahangir case which allowed provisional release of the imported consignment prayed to the court to direct the petitioner to refrain from any action against them.
The bench after hearing the counsel for customs disposing of the petition directing the Customs appellate tribunal to decide the case within 30 days. They were restrained from en-cashing the guarantee by Custom officials.
