KARACHI: A report submitted by Muhammad Siddiq Brohi, Registrar, Custom Appellate Tribunal, Bench III Karachi in response to order passed on 03.10.2024 by a Custom Appellate Bench of High Court of Sindh was discarded by the SHC bench.

The matter pertains to allowing a rectification application filed by an Appellant/Importer which was entertained and the impugned judgment was recalled by the Customs Appellate Tribunal in favor of an importer and against the Directorate of Intelligence & Investigations, Pakistan Customs.

The said judgment was challenged by the DIT in a Special Custom Reference Application (SCRA) and on previous date of hearing i.e 3.10.2024, Sardar Muhammad Ishaque Advocate appearing for the respondent importer submitted that impugned order has been recalled.

Khalid Mehmood Rajper Advocate counsel for the applicant department said that department has not received any notice of the said application and that if any application was filed by the Importer who is respondent in instant SCRA it was not entertain-able.

The SHC bench ordered the Registrar of the Custom Appellate Tribunal Bench III “to seek response from the learned single member that as to how and in what manner rectification application was entertained”.

When the SCRA came up for hearing, Registrar Siddiq Brohi appeared and filed his response. The bench after perusal expressed dis-satisfaction with the said response saying that facts stated are already available to the court. The Registrar was then asked to file an appropriate report after seeking a response from the learned single member of tribunal and submit the same on next date of hearing fixed for today i.e 21.11.2024.
