KARACHI: A custom appellate bench of High Court of Sind comprising Justice Muhammad Junaid Ghaffar and Justice Muhammad Abdur-Rahman issued notice to respondents for Nov 13 in three identical petitions filed by Kashif Shaikh, Mrs Beenish Kashif and Tanvi Alam through law firm Franklin Law Associates.
A counsel from the renowned law firm stated before the bench that goods of the petitioners were assessed and released but at Gate out stage a notice was received in respect of re-assessment persuant to certain SRO under which GST at the rate of 11 per cent was levied with out any Show Cause Notice or confronting the petitioner. The counsel for Franklin further submitted that this issue has been settled in a case titled M/s Harris Silicones & Glass Private Limited (2022 PTD 1163).
The bench after a brief hearing ordered issuance of notices to the respondent custom officials for 13.11.2024 while restraining the department from any coercive action against the petitioners.
