KARACHI: A division bench of High Court of Sindh dismissed a constitutional petition filed by South Asia Pacific Terminal (SAPT) challenging vires of Section 14 A of Customs Act 1969.
Earlier bench heard Sardar Zafar Hussain Advocate for Pakistan Customs, Deputy Attorney General Kashif Nazeer and Ali Almani advocate counsel for petitioner.
The counsel for petitioner submitted that an identical petition filed by another container terminal operator has been dismissed by this court against which an appeal is pending before Supreme Court of Pakistan in which an ad-interim order has been passed directing the petitioner to submit monthly statement of account of demurrage received from various parties and continue this till further orders.
The counsel for SAPT prayed for similar order but SHC bench declined the same saying that the judgment passed is now a “binding precedent”.
The bench with this observation dismissed the petition while suspending the same for 45 days allowing opportunity to the petitioner to file appeal before the apex court.
