KARACHI: Justice Rashida Asad of High Court of Sindh hearing a criminal miscellaneous application filed by Fida Hussain Janvery stayed proceedings before Special Judge, Anti Corruption (Central-I) and letters issued by FIA FIA/AML-CFT/K/ENQ-63/2024/12935-39, dated 18.07.2024.

Earlier the court heard Raj Ali Wahid Kunwar Advocate counsel for the applicant who submitted that F.I.A has implicated the applicant in Crime FIR No 19/2023 and initiated two separate proceeding in same FIR with identical facts, one under section 5(2) of Prevention of Corruption Act 1947, before the Special Judge, Anti-corruption (Central) and another before Special Judge, Customs, Excise & Taxation under section 156(8) (9) of the Custom Act, 1969.

The counsel further submitted that concurrent trial contravenes Article 13 (a) of Constitution of Pakistan and section 26 of the General Clauses Act. He prayed to staying proceedings before the Anti Corruption Court.

The bench after detailed hearing held that contentions raised needs due consideration. It then stayed the proceedings before the Anticorruption Court while suspending letters issued by FIA. The bench also fixed August 26 for further hearing.
