QUETTA: Hearing a petition filed by Quetta Chamber of Commerce & Industry (QCCI), a division bench of High Court of Sindh (SHC) restrained the In Land Revenue / Income Tax department from coercive recovery under newly introduced Section 7-E.
Pervaiz Khan and Muheebullah Advocate appearing for the QCCI submitted that the newly inserted section is contrary to the provisions of Article 142 0f the Constitution of Pakistan. It also amounts to double taxation, argued the lawyers for QCCI.
The bench while ordering issuance of notice said that contentions advanced raised consideration. The bench also restrained the authorities concerned from making any coercive recovery under the impugned section.
The further proceedings are likely in March 2023 after BHC winter vacations end.
