KARACHI: A constitutional petition and accompanied stay application filed by Omer Raza against apprehension of coercive recovery was dismissed by an appellate bench of High Court of Sindh (SHC) comprising Justice Junaid Ghaffar and Justice Agha Faisal.

The petitioner sought stay against coercive recovery apprehended by him during pendency of appeal before Commissioner (Appeals) In-Land Revenue.

The bench after hearing the counsel for petitioner drew attention of the petitioner to a circular/letter issued by the FBR wherein all field formations of FBR were directed to not to enforce any coercive recovery till an appeal passes the test of appellate proceedings.

The bench said that when FBR has itself taken notice of the issue and apprehension of the petitioner, the petition is not maintainable hence dismissed along with stay appeal.
