KARACHI: Hearing a pettion challenging three recovery notices issued to Jumbo International Clearing Agency, an appellate bench of High Court of Sindh comprising Justice Aqeel Ahmed Abbasi and Justice Mrs Kausar Sultana Hussain ordered issuance of pre-admission notices to the respondents for Oct 12 while customs was also restrained from taking any coercive action till next date of hearing.

The bench earlier heard a counsel from Franklin Law Associates representing the petitioner company who contended that recovery notices were in respect of import of Land Rover/Range Rover vehicles and issued without any assessment or adjudication proceedings.

It was further contended that in the light of judgments of High Court as well as Supreme Court of Pakistan, Clearing Agent has a limited role and main responsibility lies with the principal i.e importer.

The bench after brief hearing ordered notice to Federal Commerce Secretary, Collectors of Custom Appraisment, East, West besides Fareeha Afzaal Assistant Collector MCC East and Faraz Ahmed, Investigating Officer, MCC-Appraisement (R & D) East.
