KARACHI: A custom appellate bench of High Court of Sindh has issued  notices to the custom authorities including Collector Custom, Adjudication-II, Collector of MCC (Appraisement), West besides Secretary Revenue Division and Deputy Attorney General in a petition challenging issue of mis-classification being dealt as “mis-declaration”.

The bench earlier heard counsel from law firm Franklin Law Associates appearing for the importer company Messes Carlcare Services, Karachi which imported two consignments of mobile phone parts and accessories.

The importer filed the Goods Declaration under PCT Heading 8517.7000. The custom authorities disputed the said PCT heading and treated the same as “USB Data Charging Cable” classified under PCT Heading 8544.4290.

The counsel submitted that company has previously imported the same item under same PCT heading and it was never questioned by the custom authorities but in respect of new two consignments they raised the objection and also issued Show Cause Notice.

The counsel also submitted that importer is ready to give proper response to the Show Cause Notice and also prepared to secure the disputed amount of duty and taxes with the Nazir of SHC.

The counsel also requested for direction to the respondents to consider their request for provisional release.

The bench after hearing the counsel from Franklin Law Associates allowed the request and directed the respondents to consider the request for provisional released in accordance with law.

The bench also sought comments from the respondents by Sept 08, the next date of hearing with advance copy to the petitioner side.
