KARACHI: Hearing a constitution petition filed by Messers Al-Ghazi Tractors Limited, Korangi, Karachi, a division bench of High Court of Sindh allowed the petition against sectoral audit.

Renowned law firm, Franklin Law Associates represented the petitioner. A counsel from the law firm relied upon decision given by the superior court in CP-D- 5107 of 2021 and said this petition is covered under the said order.

Kafeel Ahmed Abbasi DAG and Irfan Ali Halepota advocate representing Pakistan Customs also endorsed the position.

The bench after a short hearing disposed of the petition in same terms. The Supreme Court of Pakistan has held that arbitrary selection for the audit purposes cannot be allowed and that FBR  trespassed beyond the statutory limits of Section 214-C directing the commissioner to conduct sector wise audit which is not  permitted under the laws”.
