KARACHI: Justice Adnan Iqbal Chaudhry of High Court of Sindh dismissed a number of Miscellaneous applications filed by Sheharyar Trading Lahore, a registered importer of ISAR BLACK CLUBS seeking temporary injunction against Director Intellectual Property Rights, Pakistan Customs and two competitive importers.

Nasima Mangrio Advocate represented the plaintiff while Miss Afsheen Aman appeared for the Directior IPR. During course of hearing it was found that plaintiff side has suppressed orders passed in a parallel proceedings in Constitutional Petition no CP-D 6264 of 2021 and CP-D 1850 of 2022.

The learned judge noted that Plaintiff has availed remedy available to him before special forum by filing an application under Rule 680 of Customs Rule 2001 and thus cannot agitate the same in this suit.

The bench then dismissed a number of applications by the Plaintiff seeking temporary injunction restraining the competitive importer on ground of infringement of registered trade mark.
