KARACHI: The release of goods on payment of disputed amount of duty, taxes, fine and penalty under Section 83-B of the Customs Act 1969 was ordered by a division bench of High Court of Sindh (SHC).

The bench was hearing a petition filed by Messers ATC Trading represented by Franklin Law Associates. Earlier a counsel from the law firm stated before the bench that after issuance of notice, an Order in Original (ONO) has been passed against which, petitioner has filed an appeal.

He further submitted that as  consignment is stuck up, the petitioner is willing to deposit the disputed amount of duty, taxes, fine and penalty under section 83-B of the Customs Act before the Nazir of the SHC.

“In the circumstances, by way of an interim arrangement, let the disputed amount of duty, taxes, fine and penalty be secured before the Nazir of the Court by way of pay order / bank guarantee in respect of the consignments covered by this petition” the bench ordered directing the custom officials to release the consignments as soon as amount is secured and certification is issued.

The further hearing was adjourned till March 16.
