KARACHI: The release of a vehicle 1997 model was ordered to be released. The order was passed by a customs appellate bench of High Court of Sindh comprising Zulfiqar Ahmed Khan and Justice Adnan Iqbal Chaudhry.
The bench earlier heard Ms Dil Khurram Shaheen advocate, counsel for petitioner Zafarullah Mustafai. She argued that no Show Cause Notice was issued to the petitioner neither notice of Section 171 was given to him.
The counsel for petitioner submitted that as per section 181 of the Customs Act, persons making seizure shall issue SCN within 2 months which period is extendable by another two months after which the goods/item shall be returned to the owner.
As counsel for respondent department Bilal Bhatti advocate was not present and brief was held for him, the bench on request of petitioner side allowed the provisional release of vehicle.
The counsel then referred to a recent judgment by SHC in which installation of tracker was ordered. The counsel said that this would ensure use of vehicle within limits of Karachi district. She also volunteered to submit original documents of the vehicle with the Nazir of SHC.
The bench also allowed the requests while adjourning further proceedings till March 22.
