KARACHI: Nine Special Custom Reference Applications (SCRAs) filed by Customs Collectorate against importers including Shamim Enterprise and others were disposed of here by a Customs Appellate bench of High Court of Sindh (SHC) comprising Justice Muhammad Junaid Ghaffar and Justice Agha Faisal.

The bench told Dr Shahnawaz advocate appearing for the customs that the SCRAs are directed against an interim order passed by the Special Customs Appellate Tribunal.

The bench referred to Article 194 (b) (3) and said appeals against a final order could be heard under inherent jurisdiction.

The counsel prayed that the SCRA may please be converted into constitution petition.

The bench however declined the request saying that if it was an SCRA or CP it could be converted but appeal against an interim order by an appellate forum cannot be heard and decides as such in a SCRA.
