KARACHI In order to close the door of un-neccessary litigations, a customs Appellate bench of High Court of Sindh asked the petitioners to avail the remedies available before the departmental forums.
The bench noted that importers/ petitioners challenges every action by the valuation department by filing constitution petitions while they have remedies available like adjudication proceedings.
The bench which in past ordered release of consignments under Section 81 of Custom Act of 1969 now declines relief sought asking the petitioners to follow the scheme of law. Only those petitioners are now getting relief on whose representation Valuation department has passed some orders. Thus those rushing to court in initial stage are returning empty handed. This would ease the work load on customs Appellate bench as well.
