KARACHI: Hearing a petition regarding release of a old model Wrangler Jeep, a division bench of High Court of Sindh asked that can custom officers use allegedly confiscated non custom paid vehicle.
The bench was hearing a petition filed by an auction purchaser/owner who filed a constitution petition through Ms Dil Khurram Shaheen advocate seeking release of vehicle. The counsel referred to the order passed by the Special Customs Appellate Tribunal in favour of petitioner on 2-9-2019.
Ms Afhseen Aman advocate appearing for custom side informed the bench that respondents have filed a Special Customs Reference Application (SCRA). She maintained that respondents tried to confirm from Okara about auction sale but reply was in negative. She also contended that petitioner/owner is absconder in a case.
The counsel for petitioner expressing ignorance about criminal proceedings, argued that the criminal proceedings have no nexus with the instant petition.The bench observed that if someone comes with clean hands court could help him but not otherwise. The bench inquired about number of SCRA and that when it was filed but as no order passed, the bench in view of a judgment ordered release of the vehicle.
The bench also observed that petitioner shall attend proceedings before trial court while office of the court was directed to fix SCRA in this case before the bench.
