KARACHI: A customs appellate bench of High Court of Sindh on Monday issuing pre-admission notices in a petition filed by Sitara Engineering & Service Provider for DHQ Hospital, Batkhela, KPK while directing the custom officials to consider the request for provisional release of an air-conditioning unit meant for the hospital.

The counsel for petitioner Sitara Jabeen, proprietor of the petitioner company earlier tod the bench that the petitioner is ready to secure the disputed amount. The counsel submitted that unit was imported from UAE and said hospital is a category “B” charitable hospitsl and thus exemption from duty and taxes in terms of HS Code 9914 was claimed but the custom authorities have refused to entertain the exemption claim referring to a Board letter No 17(14)/2004 Cust. Exm (pt) (Vol -III) dated 9-9-2019. The petitioner has filed an appeal in terms of section 7 of the FBR Act 2007. The petitioner has also submitted an undertaking that the imported unit will be exclusively used in aforesaid hospital for charitable purposes.

The bench after hearing in detail while issuing pre-admission notices to respondents for Nov 08 asked the respondents to consider request of the petitioner for provisional release according to law after securing amount of duty and taxes.
